TALLY PRIVACY POLICY
‍Tally Technology Group, Inc., (“Tally", "we", "our" or "us") provides this Privacy Policy to inform you about our practices and procedures concerning the collection, use and disclosure of your Personal Information (as defined below) in connection with your access to Tally promotions (the “Promotion”) (including the use of any mobile software application for the Promotion (the "App"), and the Tally websites, (collectively the "Services")). By accessing or using the Services, you consent to the information practices described in this Privacy Policy. We collect and receive information about you from various sources, including without limitation: (1) through your user account on the Services (your "Account") when you register; (2) your use of the Services generally; and (3) from third party websites and services.

‍WHAT THIS POLICY COVERS
‍This Privacy Policy covers the treatment of personally identifiable information ("Personal Information") gathered when you are using or accessing the Services. This Privacy Policy also covers our treatment of any Personal Information that our business partners share with us or that we share with our business partners. This Privacy Policy does not apply to the practices of third parties that we do not own or control, including but not limited to any third-party websites, services and applications (e.g., Google Analytics, Facebook, Twitter, etc.) (each a "Third-Party Service") that you elect to access through the Services or to individuals that we do not manage or employ. We cannot take responsibility for the content or privacy policies of those Third-Party Services. We encourage you to carefully review the privacy policies of any Third-Party Services you access.

INFORMATION WE COLLECT
 

Information you provide to us.  Personal Information you provide to us through the Services may include the following:

  • ACCOUNT & PROFILE INFORMATION. If you create an Account with us, you will be required to provide us with certain information, including, but not limited to, your name, phone number and/or email address, username and Account password. You acknowledge that this information may be personal to you, and by creating an Account and providing Personal Information to us, you allow others, including us, to identify you, and therefore you may not be anonymous. 

  • DEMOGRAPHIC INFORMATION. Demographic information may include your city, state, country of residence, postal code, and age as well as consumer preferences you might share with us

  • INFORMATION COLLECTED THROUGH YOUR CORRESPONDENCE WITH US. We collect information if you contact us for support or help, or otherwise communicate with us.

  • INFORMATION COLLECTED FROM YOUR USE OF THE SERVICES. When you use the Services, we automatically collect certain information, which may include Personal Information, regarding your access to and use of the Services. This information may include, but is not limited to, your IP address, device type, language, referring website URLs, log files, pages on the website that you visit, and links you click on (collectively, "Usage Information"). We also collect information, including Personal Information, you choose to provide through your use of the Services (for example, if you provide comments to an article or submissions to a forum). If you use our Services on a mobile device, you may choose to provide us with location data. 

  • MARKETING INFORMATION. This includes your preferences for receiving communications about our activities, events, and publications, and details about how you engage with our communications.

  • USER CONTENT. User content includes content you provide to the Services, such as content shared through chat, or your picks or predictions. After termination of your Account, we may continue to disclose content you posted publicly to third parties, as described in this Privacy Policy.

  • PUBLIC ACTIVITY ON THE SERVICES. Some of your activity on and through the Services is public. This may include, but is not limited to, content you have posted publicly on, through or in connection with the Services, including without limitation on public portions of Third-Party Services, such as your social media accounts.  Please remember that if you choose to provide Personal Information using certain public features of the Services, then that information is governed by the privacy settings of those particular features and may be publicly available. Individuals reading such information may use or disclose it to other individuals or entities without our control and without your knowledge, and search engines may index that information. We therefore urge you to think carefully about including any specific information you may deem private in content or information that you create or submit through the Services.

  • LOCATION INFORMATION. Some of our Services may include features based on users' actual locations and may report on users' current locations ("Location-Based Services"). To the extent you voluntarily opt to use any Location-Based Services, we may collect and store information about your location at the time you use those Location-Based Services. Additionally, we may also collect and/or receive location information from your use of the Services generally, which can come from a variety of sources, depending on how you use or access the Services. For example, an image taken from your mobile device may contain location information related to where the image was taken, or a mobile device may report its GPS location at the time Location-Based Services are used.

  • OTHER INFORMATION. Including information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.


INFORMATION OBTAINED FROM THIRD-PARTY SERVICES.  We may maintain pages for our Company on social media platforms, such as Facebook, LinkedIn, Twitter, Google, YouTube, Instagram, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform providers’ privacy policies will apply to your interactions and their collection, use and processing of your Personal Information. You or the platforms may provide us with information through the Services, and we will treat such information in accordance with this Privacy Policy. 

‍COOKIES AND SIMILAR TECHNOLOGIES. We utilize certain technologies to recognize you when you use the Services, track your interactions with the Services, and personalize your experience. These include devices such as cookies, web beacons, pixels, mobile device identifiers and similar technologies. Cookies are small data files we transfer to your computer hard drive. We utilize some cookies that remain on your computer after you leave the website so that we can recognize you when you return and provide a more personalized and helpful experience. We also utilize session cookies to enable certain features of the website, to better understand how users interact with the website and monitor use of the website users and web traffic to the website. Session cookies are deleted from your computer when you log off from the website and close your browser. In our mobile application, we may collect this information directly or through our use of third-party software development kits (“SDKs”). SDKs may enable third parties to collect information directly from our App. A SDK is third-party computer code that we may incorporate into our mobile applications that may be used for a variety of purposes, including to provide us with analytics regarding the use of our mobile applications, to integrate with social media, add features or functionality to our app, or to facilitate online advertising.

‍INFORMATION FROM THIRD PARTIES. We may receive information about you and your activities on other sites or services from third parties we work with, including affiliates and advertisers. For example, a business partner may share your contact information with us if you have expressed interest in learning specifically about our products or services, or the types of products or services we offer. We may obtain your Personal Information from other third parties, such as marketing partners, publicly-available sources and data providers.

‍INFORMATION FROM OUR PARTNERS: We may receive information about you from other sources and include that with the personal information we have collected. Examples of sources of this information include third party business partners and sponsors of promotions and contests operated by Tally. This information is used to fulfill the promotion or contest and contact the winner. By sharing your personal information in these instances, you agree that your personal information may be used by Tally and our partners. Also, while participating in any of these promotions or contests, you may choose to participate in other Tally or partner offerings, such as SMS texting services. 
 

HOW WE USE YOUR PERSONAL INFORMATION

‍We may use your Personal Information for the following purposes and as otherwise described in this Privacy Policy or at the time of collection: 
‍TO PROVIDE AND OPERATE THE SERVICES. We use your Personal Information to: provide, operate, and improve the Services, facilitate your login to the Services , provide support and maintenance, and respond to your requests, questions and feedback. 

‍FOR RESEARCH AND DEVELOPMENT. We analyze use of the Services to improve the Services and to develop new products and services, including by studying user demographics and use of the Services. 

EMAIL, TEXT, and PUSH NOTIFICATION COMMUNICATIONS, INCLUDING MARKETING COMMUNICATIONS.  We may communicate with you via, email, SMS, MMS or other text message ("Message") (to the extent you permit us to do so), and we may collect information regarding such communications, such as confirmation when you open an email, or read a message. We use this information to improve our Services, including without limitation, our customer service. You will have the opportunity to opt-out of our marketing and promotional communications as described below in the “Your Choices” section of this Privacy Policy. 

TO DISPLAY ADVERTISEMENTS. We work with advertising partners to display advertisements on the Services or elsewhere online. These advertisements are delivered by our advertising partners and may be targeted based on your use of the Services or your activity elsewhere online.

TO COMPLY WITH LAW. We use your Personal Information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.
‍FOR COMPLIANCE, FRAUD PREVENTION AND SAFETY.  We may use your Personal Information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern the Services; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

‍WITH YOUR CONSENT.  In some cases we may specifically ask for your consent to collect, use or share your Personal Information, such as when required by law.  

‍AGGREGATE AND NON-PERSONALLY IDENTIFIABLE INFORMATION.  Generally, the Services automatically collect usage information, such as the number and frequency of visitors to the App and other information about users of the Services. We may use this data in aggregate form, that is, as a statistical measure, or in other anonymous forms, but not in a manner that would identify you personally. This type of data enables us and third parties authorized by us to figure out how often individuals use parts of the Services so that we can analyze and improve them.

‍HOW WE SHARE YOUR PERSONAL INFORMATION

‍We do not share your Personal Information with third parties without your consent, except in the following circumstances or as described in this Privacy Policy: 
‍AFFILIATES.  We may share your Personal Information with our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.

‍INFORMATION SHARED WITH OUR SERVICE PROVIDERS.  We utilize third parties to perform certain tasks on our behalf, such as to assist with prize fulfillment, collecting and analyzing data, providing search results and links (including paid listings and links), and providing advertising and marketing assistance, including serving ads on our behalf on third-party websites and mobile applications and serving ads on behalf of third parties within certain of our offerings, among other things. We may need to share Personal Information with our third-party service providers in order to provide products or services to you. You hereby consent to our sharing of Personal Information with our third-party service providers in accordance with the terms of this Privacy Policy.

‍THIRD-PARTY PLATFORMS AND SOCIAL MEDIA NETWORKS. If you have enabled features or functionality that connect the Services to a third-party platform or social media network we may disclose the Personal Information that you authorized us to share. We do not control the third party’s use of your Personal Information.

OTHER USERS OF THE SERVICES AND THE PUBLIC. We may provide functionality that enables you to disclose Personal Information to other users of the Services or the public. For instance, you may be able to maintain a user profile with information about yourself that you can make available to other users or the public. You may also be able to submit content to the Services (such as comments, reviews, surveys, blogs, photos, and videos), and we will display your name, username, and a link to your user profile along with the content you submit. We may make available settings through the Services that enable you to exercise choice regarding certain information that is displayed publicly or to other users. We do not control how other users or third parties use any Personal Information that you make available to such users or the public.

PROFESSIONAL ADVISORS. We may disclose your Personal Information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.

‍SAFETY AND LEGAL PURPOSES.  We may disclose your information if there is a violation of our Terms of Use or other agreements; if we have a reasonable, good-faith belief that the law requires it; or if we reasonably believe it necessary to protect the rights, property or safety of Tally, our users or others. This includes, but is not limited to, providing information to third parties for the purposes of fraud detection and protection, and credit risk reduction.

‍INFORMATION DISCLOSED PURSUANT TO BUSINESS TRANSFERS.  In some cases, we may choose to buy or sell assets. In these types of transactions, user information (including your Personal Information) is typically one of the transferred business assets. Moreover, if all or substantially all of our assets were acquired by another party, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Information as set forth in this policy.

‍YOUR CHOICES

In this section, we describe the rights and choices available to all users. 
‍ACCESS OR UPDATE YOUR INFORMATION. If you have registered for an Account with us, you may review and update certain Personal Information in your profile by logging into the Account.

‍OPT OUT OF OPERATIONAL COMMUNICATIONS. We may use your contact information to send you information about our Services. You may unsubscribe from some of these messages by emailing us at unsubscribe@playtally.com, although we, regardless, reserve the right to contact you when we believe it is necessary, such as for account recovery purposes. If you provide your phone number through the Services. You may opt out of SMS communications by texting STOP to +1 866-340-6056.

‍OPT OUT OF MARKETING COMMUNICATIONS.  You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us at unsubscribe@playtally.com.  You may continue to receive service-related and other non-marketing emails.  If you receive marketing text messages from us, you may opt out of receiving further marketing text messages from us by replying STOP to our marketing message. You may also text STOP to +1 866-340-6056.

‍COOKIES.  You maintain control over some of the information we collect through the use of cookies, and you can set your preferences regarding the use of cookies through your browser settings. If you choose not to accept cookies, you may not be able to access portions of the website or all functionality of the Services.    

‍PRIVACY SETTINGS AND LOCATION DATA. We make available certain privacy settings on the Services. Users of our mobile application also have the choice whether to allow us to access your precise location data. Your device settings may provide the ability for you to revoke our ability to access location data.

‍TARGETED ONLINE ADVERTISING. Some of the business partners that collect information about users’ activities on or through the Services may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior or mobile application usage for purposes of targeted advertising. 

Users may opt out of receiving targeted advertising on websites through members of the Network Advertising Initiative by clicking here or the Digital Advertising Alliance by clicking here. Users of our mobile applications may opt out of receiving targeted advertising in mobile apps through participating members of the Digital Advertising Alliance by installing the AppChoices mobile app, available here, and selecting the user’s choices. Please note that we also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms that we linked above.

In addition, your mobile device settings may provide functionality to limit our, or our partners’, ability to engage in ad tracking or targeted advertising using the Google Advertising ID or Apple ID for Advertising associated with your mobile device.If you choose to opt-out of targeted advertisements, you will still see advertisements online but they may not be relevant to you. Even if you do choose to opt out, not all companies that serve online behavioral advertising are included in this list, so you may still receive some cookies and tailored advertisements from companies that are not listed.

‍DO NOT TRACK.  Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit.  We currently do not respond to “Do Not Track” or similar signals.  To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

‍THIRD-PARTY PLATFORMS. If you choose to connect to the Services via a third-party platform or social media network, you may have the ability to limit the information that we may obtain from the third-party at the time you login to the Services using the third-party’s authentication service or otherwise connect your Account. Subsequently, you may be able to control your settings through the third-party’s platform or service. If you withdraw our ability to access certain information from a third-party platform or social media network, that choice will not apply to information that we have already received from that third-party.Where we are required by law to collect your Personal Information, or where we need your Personal Information in order to provide the Services to you, if you do not provide this information when requested (or you later ask to delete it), we may not be able to provide you with our services.  We will tell you what information you must provide to receive the Services by designating it as required at the time of collection or through other appropriate means.

POLICY REGARDING CHILDREN

‍Our Services are not intended for any persons under 18 years of age, and we do not knowingly collect Personal Information from persons under 18 years of age. If you are a parent or guardian and believe that your child has provided Personal Information to us without your consent, please contact us at legal@playtally.com. If we become aware that any person under 18 years of age has provided us with Personal Information, we will delete such information from our files.

SECURITY

We follow generally accepted industry standards to protect the information we collect, maintain and transmit. We have in place commercially reasonable administrative, technical and physical safeguards intended to protect Personal Information against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unauthorized form of processing of the Personal Information in our possession. This includes, for example, firewalls, password protection and other access and authentication controls. We use SSL technology to encrypt data during transmission through public internet, and we also employ application-layer security features to further anonymize Personal Information. However, no method of transmission over the Internet, or method of electronic storage, is completely secure. We cannot, and do not, guarantee the security of any information you transmit to us or store on the Services, and you do so at your own risk. We also cannot, and do not, guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. ‍DELETING YOUR ACCOUNT.  Should you ever decide to delete your Account, you may do so by emailing us at legal@playtally.com. If you terminate your Account, any association between your Account and information we store will no longer be accessible through your Account. 

‍CHANGES TO THIS PRIVACY POLICY

We may make changes to this Privacy Policy from time to time, in our discretion. If we make any material changes we will post the revised Privacy Policy on the Services prior to any changes becoming effective. You should review our Privacy Policy each time you access or use the Services. Your continued use of the Services following the posting of any changes or notice to you of the changes constitutes your agreement to such changes.

YOUR CALIFORNIA PRIVACY RIGHTS

We do not share your Personal Information with third parties for their direct marketing purposes without your consent. Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for notice identifying the categories of personal customer information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties.
